These Terms and Conditions (“Terms”) govern your use of our website, mobile app, and services (collectively, the “Platform”).

1. Definitions

  1. “NOTI”, “we”, “us”, or “our” refers to NOTI Marketplace Company Limited.
  2. “User”, “you”, or “your” means any person accessing or using the Platform, whether as a buyer, seller, or visitor.
  3. “Seller” means any individual or business that lists and sells products on NOTI.
  4. “Buyer” means a user who purchases goods or services via the Platform.
  5. “Order” means a confirmed purchase request placed by a Buyer.

2. Use of the Platform

  1. You must be 18 years or older or under the supervision of a parent/guardian to use NOTI.
  2. You agree to provide accurate and up-to-date information when creating an account or placing orders.
  3. You are responsible for maintaining the confidentiality of your account login details.
  4. We reserve the right to suspend or terminate any account that violates these Terms or engages in fraud or misuse.

3. Orders and Payments

  1. All prices are listed in Tanzanian Shillings (TZS) and are inclusive of applicable taxes unless stated otherwise.
  2. Orders are confirmed once payment is verified or accepted for Cash on Delivery transactions.
  3. NOTI reserves the right to cancel or refuse any order due to stock unavailability, pricing errors, or suspected fraud.
  4. Payment methods include mobile money (M-Pesa, Tigo Pesa, Airtel Money), bank transfer, and Cash on Delivery where available.

4. Shipping & Delivery

  1. Delivery timelines depend on product type, seller location, and buyer’s address.
  2. Estimated delivery time is displayed at checkout and confirmed via order tracking updates.
  3. Delays caused by external factors (e.g., weather, road conditions, third-party logistics) are beyond NOTI’s control.

5. Cancellations, Returns & Refunds

  1. Orders can be canceled before shipment as per the [Cancellation Policy].
  2. Returns are accepted for eligible items within 7 days of receipt, subject to inspection and approval.
  3. Refunds are processed within 3–10 business days once confirmed.

6. Seller Responsibilities

  1. Sellers must ensure their listings are accurate, truthful, and compliant with Tanzanian laws.
  2. Sellers are responsible for product quality, packaging, and timely delivery.
  3. Counterfeit or prohibited products are strictly forbidden and will lead to immediate account suspension.

7. Prohibited Activities

You agree not to:

  1. Post, sell, or distribute illegal, counterfeit, or restricted items.
  2. Use the platform for fraud, spam, or misleading promotions.
  3. Violate the intellectual property rights of others.
  4. Interfere with system security, data, or the experience of other users.

8. Privacy & Data Protection

Your personal data is handled in accordance with the NOTI Privacy Policy, which explains how we collect, use, and protect your information.

By using NOTI, you consent to this processing as required under Tanzanian data protection laws.

9. Communications

By creating an account, you agree to receive:

  1. Order updates via SMS, email, or push notifications
  2. Marketing or promotional messages (which you can opt-out of anytime)

10. Intellectual Property

All logos, designs, trademarks, and content on the NOTI platform are owned by NOTI Marketplace Company Limited or its licensors.

You may not copy, reproduce, or use them without written permission.

11. Limitation of Liability

NOTI acts as a digital marketplace connecting buyers and sellers.

We are not the manufacturer or direct seller of all listed products.

We shall not be liable for:

  1. Product defects caused by the seller or manufacturer
  2. Delivery delays due to third parties
  3. Any indirect, incidental, or consequential damages

12. Dispute Resolution

In case of any dispute:

  1. First, contact NOTI Support for resolution.
  2. If unresolved, disputes may be settled under the laws of the United Republic of Tanzania, through mediation or arbitration in Dar es Salaam.

13. Changes to These Terms

We may update these Terms from time to time.

The most recent version will always be available on our website and mobile app.

Your continued use of the platform after any changes means you accept the updated Terms.
